1. Introduction
These Terms and Conditions ("Terms") govern your use of the Buni mobile application ("the App"), the BuniCoin blockchain platform, and related services (collectively, "the Services") provided by Bunasilia Technologies, a sole proprietorship registered under the Business Names Act (Cap 499) of the Laws of Kenya with Registration Number BN-2RC5P282.

2. Acceptance of Terms
By downloading, installing, or using Buni, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years of age to use Buni. By using the App, you represent and warrant that you meet this age requirement.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App or on our website.
3. Account Registration
To access Buni, you must create an account by providing a valid email address or Google account, a unique username, your gender, and optionally your first name, last name, and date of birth.
You are responsible for maintaining the confidentiality of your login credentials. You may not create more than one account without our express written permission. We reserve the right to suspend or terminate duplicate accounts.
4. Wallet Activation & Payments
To access earning features (mining, rewards, withdrawals), you must activate your digital wallet by paying a one-time, non-refundable activation fee of Kenya Shillings One Hundred and Thirty (KSH 130) via M-PESA STK Push through Safaricom PLC's payment gateway.
We are not responsible for failed transactions due to insufficient funds, incorrect PIN entry, network failures, or other issues beyond our control.
BuniCoins may be converted to Kenyan Shillings and withdrawn to your M-PESA account. Withdrawals are subject to minimum thresholds, processing times of up to 24 hours, and verification of account ownership.
5. BuniCoin & Blockchain
BuniCoin is a proprietary digital currency operating on the BuniCoin blockchain. It is not legal tender in Kenya or any other jurisdiction, is not backed by any government or central bank, and is not an investment, security, or financial instrument.
BuniCoins are earned through mining rewards distributed based on leaderboard rankings. As the operator and regulator of the BuniCoin blockchain, Bunasilia Technologies reserves the right to modify mining rates, adjust reward structures, implement blockchain updates, or suspend the blockchain in extraordinary circumstances.
The conversion rate of 1 BUNI = 100 KSH may be adjusted with notice to users.
6. User Conduct
You agree not to:
• Post illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
• Impersonate any person or entity
• Use the App for commercial purposes without authorization
• Attempt to manipulate the leaderboard, virality scores, or mining rewards
• Reverse engineer, decompile, or disassemble the App
• Use automated bots or scripts to artificially inflate engagement metrics
• Violate any applicable Kenyan laws or regulations
We reserve the right to remove any content that violates these Terms at our sole discretion.
7. Intellectual Property
All intellectual property rights in the App, BuniCoin blockchain, branding, logos, and technology are owned by or licensed to Bunasilia Technologies.
"Buni," "BuniCoin," and "Bunasilia Technologies" are trademarks owned by Bunasilia Technologies. You may not use these without our prior written consent.
8. Limitation of Liability
The App and Services are provided on an "as is" and "as available" basis without warranties of any kind.
To the fullest extent permitted by Kenyan law, Bunasilia Technologies shall not be liable for:
• Loss of BuniCoins due to technical failures or blockchain issues
• Loss of data, profits, or business interruption
• Damages arising from M-PESA transaction failures
• Losses from changes in BuniCoin conversion rates
• Any indirect, incidental, special, or consequential damages
Our maximum liability for any claim shall not exceed the activation fee paid by the user or KSH 1,000, whichever is lower.
9. Termination
You may terminate your account at any time by contacting us. Upon termination, your BuniCoin balance will be forfeited unless withdrawn prior to termination.
We may suspend or terminate your account for violation of these Terms, suspected fraudulent activity, extended inactivity (12+ months), or any reason at our discretion with reasonable notice.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
Before initiating legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at admin@bunasiliatechnologies.co.ke.
11. Future Plans
Bunasilia Technologies is currently a sole proprietorship with plans to transition to a Limited Liability Company (LTD) under the Companies Act, 2015 (Kenya). Users will be notified of any changes to our legal structure. We are continuously developing new features, and these Terms cover all current and future features unless explicitly stated otherwise.
